NORTH COAST GARDENING: A musical interlude at the garden ...

Get thee to the garden on Sundays -- the Humboldt Botanical Garden, that is. Beginning this Sunday, the Humboldt Botanical Garden will celebrate summer by presenting the first musical offering in its summer series of music called ?First Sundays at the Garden.? While the garden will be open every Sunday from 11 a.m. to 3 p.m. this summer, it will also offer live music the first Sunday of each month.

Performing this Sunday will be Reflection, a vocal trio with acoustic guitar performing folk tunes and standards. Also on the program is Humboldt Light Opera Company's women's ensemble ?The Babes.? This is a wonderful family event where you can pack up a picnic lunch, spread out a blanket on the soft green grass and listen to quality local music in a beautiful public garden.

And while you are at the Humboldt Botanical Garden, check out all the beautiful core gardens. The Dedekam Ornamental Terrace Garden is a rainbow of colors planted in bands of red, orange, yellow and blue. Plants were selected for their foliage, flower color and hardiness. A striking feature of this garden is the pair of formal storm water runnels that flow from the top of the garden into the Lost Coast Brewery Native Plant Garden water feature below.

Central to the Humboldt Botanical Garden is the Lost Coast Brewery Native Plant Garden. Covering more than an acre, this garden is the largest native plant garden in Northern California, offering habitat to weasels,

rabbits, foxes, hawks, bobcats and a variety of songbirds and butterflies. This garden provides visitors with striking examples of how native plants can be aesthetically integrated into home landscapes.

Cross over a rustic foot bridge and discover the wild things in Wildberries Natural Riparian Area. Central to this garden is Fault Creek, a year-round, free-flowing spring that bisects a rich community of native willows, berries, flowering currant, red alders and other natives. The wild berries of this riparian garden include California blackberry plants, thimbleberry, salmonberry and evergreen huckleberry and wild currant. Migratory songbirds such as Wilson's warbler, Swainson's thrush and black-headed grosbeak make this garden their home.

The Moss Family Temperate Woodland Garden is located slightly inland and up in elevation from the lower gardens. Because this garden is tucked within a bowl surrounded by steep grassy hills and tall Sitka spruce forest, it is protected from stiff coastal winds. Often the temperature can be as much as 10 degrees warmer.

The Moss Family garden offers an extensive rhododendron collection, a bed of the enchanting true blue Himalayan poppy, the Raul Ruiz Iris Douglasiana Reserve and the rare Wollemia pine. This tree, once thought to be extinct, was known only from fossils dating from 120 million years ago. A group of 30 or so were discovered in 1994 at the bottom of a canyon in the Blue Mountains of New South Wales, Australia.

Peter Santino's All Happy Now Earth Sculpture, located at the uppermost reaches of the garden, is the only one of its kind in North America. It is a merger of two ancient landscape architectural features, the ziggurat and the labyrinth. Based on a mathematical equation named Fermat's Spiral, the 100-foot diameter earth mound is covered with grass and features two non-intersecting quarter-mile pathways which take the walker to the center and back down out the opposite side. It is intended to be walked in the manner of the meditation labyrinths found in churches and cathedrals.

The Humboldt Botanical Garden is located at the north end of the College of the Redwoods campus, on Tompkins Hill Road. Summer hours starting next Wednesday (June 6) are Wednesday through Saturday from 10 a.m. to 2 p.m. and Sunday from 11 a.m. to 3 p.m. Admission is free for garden members, $5 for non-members and free for children under 12.

Beginning this fall, confidentiality privileges long enjoyed by attorneys and their clients will be extended to labor organizations and their members, raising concerns that these new protections could interfere with federal law.

One of hundreds of bills that came across Gov. Martin O?Malley?s desk for his signature earlier this month, the new law will protect union representatives from having to disclose information received in confidence from an unhappy union member during grievance proceedings.

According to the bill?s sponsor, Sen. Brian Frosh, D-Montgomery, the new law will extend the confidentiality clause applied to relationships between physicians and patients, psychologists and patients, clergy and parishioners, and attorneys and clients to unions and employees. Certain information disclosed under these relationships are protected as confidential by one of the oldest parts of common law.

First time for new protections

Much as in those protected relationships, communication pertinent to a criminal proceeding is not protected nor is communication that reveals the intent to inflict harm on another individual. Nevertheless, the new law remains a broad protection extended to labor unions for the first time in the state.

During Senate debate in March, Frosh disputed Republican attacks that the bill was unfair to business owners and should be extended to them as well rather than just unions and their representatives.

?This bill is not about protecting the union,? Frosh argued, ?it?s about protecting the employee.?

Frosh said a union representative is acting on behalf of employees and their grievances before management, which is not the case in a relationship between employers and their employees.

Supporters have said the extended protections will allow employees to utilize unions without fear that their words could threaten their job.

The bill was approved by the Senate and House of Delegates along party lines, with the majority of Republicans opposing it.

For employers, the new law, which will go into effect Oct. 1, presents a series of new regulations as to how they deal with labor unions and their members. There are exceptions to what information is protected when an employee takes a grievance to a union representative, including certain information a union is required to disclose under federal law. But no case has yet found its way before a judge for interpretation by a Maryland court.

Business group objected

The Maryland Chamber of Commerce raised questions about the scope of the state law.

Although the law includes a ?savings clause,? which prohibits the state law from trumping federal rules, the Maryland Chamber of Commerce believes it will still conflict with federal law regulating a union?s duty to furnish information to an employer.

?The ?savings clause? only complicates matters and will force employers to file charges against a union, and thrust arbitrators, administrators, and courts into matters that are directly regulated by the [National Labor Relations Act],? the Chamber said in a statement explaining their position.

Gary Simpler, an attorney who focuses on labor law and is a partner with a firm that advises the Maryland Chamber of Commerce, echoed concerns that the state may be stepping into territory regulated by federal law.

?Generally, we?re not looking to the union to provide us information for our cases, but there could be instances where this statute would interfere,? Simpler said, adding that it wouldn?t be the first time the state has passed legislation interfering with federal labor rules.

Asked whether the extended protections would impact his practice, Simpler predicts the new law?s impact will be modest, but not nonexistent.

According to Simpler, the new protections could draw out legal proceedings and put employers at a financial disadvantage.

?There could be instances where the union does have access to information that they?ve obtained from the [employee] that would be important in helping the employer make an informed decision,? said Simpler. ?If they had the information they might have made a different decision or resolved the case much quicker than when they only learned about the information at the hearing.?

Women's Exercise Issues and Protocols | Weight Loss | Diet | Fitness ...

It seems as though we are all bombarded on a daily basis with a plethora of the latest and greatest infomercials and sales pitches pertaining to dieting and the benefits of exercise by the various forms of the media such as newspapers, magazines and television as well as online.

Although all of this press definitely stimulates an increased awareness for diet and exercise, researchers and the majority of the public now concur and acknowledge that it is important to avoid dangerous and often ineffective and costly diet and exercise fads and instead, focus upon making prudent meal plan choices and remain physically active on a daily basis. As a nutrition, fitness and wellness coach, this is the mindset I have strived to pass on to the many women fitness clients and athletes I have counseled and coached over the past 20 years.

Since the advent of increased exercise and athletic opportunities for women and girls in the late-1970?s, many of the long-standing myths and misconceptions pertaining to females, healthy body image and strength training exercise have been overturned. Yet unfortunately due largely to the media continuing to perpetuate the female ?princess syndrome? many of the myths and misconceptions regarding this subject still prevail not only in many men?s perception of females and strength training exercise, but also ironically, to many women as well.

Chief among these is the belief that a woman will become too muscular and appear unfeminine, particularly from strength training forms of exercise. Research has established that the role individual hormone levels play in the development of strength and muscle growth is significant, although quite variable from person to person.

In their 1998 Physician and Sports Medicine article pertaining to women?s strength training issues, Ebben and Jensen state that testosterone levels in women are usually about one-tenth that of men and these even widely fluctuate amongst women. This would account for the reason why some women are able to develop a greater degree of muscular size, strength and definition than their peers.

Ideally, a sound exercise program should include a well-balanced emphasis on the following chief components including; enhancing functional muscular strength, power and endurance as well as cardiovascular fitness and muscular flexibility. For many women, the initial phases of their training program will also likely initially incorporate progressive weight loss techniques and eventually, a weight management component.

A woman needs to carefully examine and access her particular genetic traits prior to beginning her exercise training so that her program will satisfy her individual needs and goals in a healthy and realistic manner rather than adhere to established gender based misconceptions and stereotypes. Therefore, undergoing a thorough fitness assessment prior to beginning with a training program is highly recommended.

This particularly holds true when considering several of the primary benefits many women desire and can derive from exercise. These benefits include enhanced bone density and the restructuring of body composition through the loss of adipose tissue or body fat and building lean and well defined muscle tissue. The latter of which, in conjunction with a sound nutrition program, is essential in creating an effective long-term weight management program.

These physiologic changes occur as a result of systematically subjecting bone, muscle and connective tissue to an increased training stimulus or training load over a predetermined time.

As Ebben and Jensen determined through their research, the greater the muscular overload, within personal limitations, the greater the amount of positive physiological change that occurs. This change includes an increase in functional strength, joint stability and integrity which significantly reduces the risk of injury, especially fractures from falling incidents which when combined with advanced stages of osteoporosis can lead to serious health consequences, especially for women over 65 years of age.

Although the use of machines need not be totally eliminated from a strength training program, the use of multi-plane movements in combination with a free-weight based exercise program are more effective for developing functional strength and an enhanced ease of adapting to managing the stress and physical requirements of daily activities.

A well-balanced program will incorporate 1-3 sets of eight to 12 repetitions performed for all the major muscle groups; chest, back, shoulders, torso, hips, thighs and calves. For post-menopausal women an emphasis is usually placed on developing and maintaining strength, stability and integrity of the hip joint as weakness and instability in this area is usually the culprit in falling and subsequent hip fracture incidents.

Exercise and pregnancy is another concern for an increasingly broader audience of women as many more women are putting off having children until after the traditional child bearing years in pursuit of career interests. More research in this area has supported the recommendation that exercise is beneficial before, during and post-pregnancy. Upon getting an OK from a doctor, a woman should strive to exercise two to three times each week in 20 minute intervals.

Although exercising vigorously during pregnancy is fine, exercises that involve any bouncing or ballistic movements or exercising in extremes of temperature should be avoided. Exercises that involve excessive bending over or require that you lie on your back are to be avoided after the onset of the third trimester. Be sure to drink plenty of water during exercise sessions and be sure to stop exercising if you feel overheated or dizzy. Maintaining your fitness during pregnancy will help with delivery and also facilitate a quicker post-pregnancy recovery.

In conclusion, although exercise protocols are essentially very similar for men and women in many respects, there are issues and situations which are unique to women and being as such, require specialized attention in order to insure that an exercise program is safe, effective and enjoyable. Maintaining a balance of these three program components is essential for long-term success and program adherence.

Consulting with a knowledgeable fitness & nutrition professional is a great first step and a sound investment toward developing a nutrition and exercise program that is fun, enjoyable, and ideally suited to empower a women to successfully and healthfully meet her specific health & wellness needs and goals.

Live, work and do business!: NETWORKING SUPER POWERS FOR ...

You may be surprised to know that I am shy. People usually are. They see me speaking at a luncheon or Chamber function. It's much easier to speak to a room of people who are interested? in what I have to say (at lease I think they are) than it is at a cocktail reception or business after hours where I have to make small talk. If I had to network that way for my own small business, I would be terrible.

Yet, networking is vital for your business. And there is tremendous value in this collaboration for our local tourism industry. Our rural community is increasingly seen as a place for entertainment, leisure activities, and an alternative to a busy urban area. Visitor requests for information are more than three times what it was at this time last year. We can thank the beautiful cultural heritage of the Palouse region for this increased interest and can use this identity marker as a means to promote our farm products, cottage industries and other local producers through rural tourism.

Using our heritage for promotion is not only a fashionable trend right now, but also shows a community's social, economic and political determination. We are discovering a new-found interest for our own rural identity, and as tourists come into the area, they buy local products, eat in local restaurants and represent a sizeable source of income.

Visitors are intrigued when a restaurant features locally grown products or a boutique hotel has locally made lotions and soaps in each room. Let's work on promoting the region as a whole! This requires building these business relationships between grower/manufacturer and retail. The Pullman Chamber offers many networking options each month to get out and hobnob with other business owners - meetings, luncheons, and after-hours. What a great way to find that new product for your business, or a new way to incorporate the Palouse into your business identity.

Increasingly exercise is being advocated as a treatment strategy for a range of?medical conditions. In response, a new field of 'clinical exercise prescription' has?evolved. Clinical exercise specialists aim to prescribe safe and physiologically?sound programmes. These specialists working with clients in clinical settings?often create a dependence that effectively changes the client's perception of?physical activity or exercise. We encourage this dependence by over-complicating?exercise prescription.

Consider the above statement and provide well argued support for your interpretation of?the statement.

Exercise prescription experts working in the clinical setting overly complicate exercise prescription creating a dependency. This tendency to encourage the individual to brainlessly defer to the ?expert? is symptomatic of what is happening throughout modern society: The insidious process of disempowerment of the individual and the granting of their power of choice to both the State and to the professional Expert. The two drivers of this process are the desire of others to get their hands on the hard-earned dollars of the individual and the ever-growing need by the State to have total control over every aspect of its citizens? lives.?

An expert is a person who belongs to a secretive organisation, called a ?profession?. For a group to be a profession it must have, in addition to rituals of initiation, such as exams and internship, it must have its own secret language in the form of special acronyms and long-winded words.?

In the profession of orthopaedics, for example, indecipherable acronyms abound. These leave the prostate patient in a state of confused awe and helplessness before the God-like specialist.

The diagnosis,?IDKJ?, is authoritatively pronounced by the orthopaedic surgeon and recorded for posterity upon the ?God-Sheet?. Upon viewing this pronouncement from On High, all those down the priestly line of command obediently respond with appropriate mutterings of agreement and the patient is anointed with ritualistic treatments, such as ultrasound and core conditioning. ?IDKJ?, if you would like to know, is priestly code for ?Internal derangement of the knee joint?. That still does not mean much at all to the unwashed. There are actually codes within codes. IDKJ has three meanings. Translated from professional orthopaedic jargon, ?IDKJ? actually means ?You have something wrong with your knee?. But wait - there?s more to this code. It really means ?I Don?t Know Jack-shit?. Only those high up within the orthopaedic priesthood know that one! So, if they don?t know jack-shit about what is going on with a person?s sore knee, why don?t they say so? The reason why they do not is because doing so would be giving away some of the power they have over the individual.

Knowledge is Power: with Ignorance it is Control

This process of disempowerment is in evidence within clinical exercise prescription. The average reading age of New Zealand adults is 13 years, so why use words like ?biceps? or ?abdominals? when working with a patient when ?upper arm? and ?tummy? will suffice? Why teach incredibly complex and potentially dangerous exercise routines that involve teetering on an over-sized ball that requires constant supervision to prevent complete confusion and inevitable injury from falling off when the same could be achieved with mowing the lawn with a hand-mower or digging the garden with a spade? Which is better when it comes to real practical rehabilitation? Unless the patients are in training for the next Swiss Ball Olympics!

Further complicating matters for the patient is the drive by over-inflated egos which require constant pumping. Experts need to totally bamboozle their patients to create a dependency which will keep pumping hard to ensure their ego doesn't deflate. Utter complexity with the aid of exclusive props (very expensive exercise machines), along with not really understanding a single word of the professional language ensures patients keep coming back. And this of course equals profit!

Exercise prescription must of course address the health issue at hand, but needs to be in a form that the individual can apply to their unique personal circumstances, relevant to their everyday life. It must be based on their lifestyle and what they prefer to do, without reliance on expensive and fairly inaccessible exercise equipment. When a patient goes to a rehabilitation clinic they are expected to leave their brain in the carpark. Instead, exercise prescription should empower the individual. Experts should be telling the patient ?when you get out of the car, don't forget your brain, because you will be needing it!?.

Zuckerberg's Wedding Brings Estate Planning Issues

In the past week, Mark Zuckerberg, the founder of Facebook, married his longtime girlfriend Priscilla Chan. While the wedding was small, the money and property that Chan married into is not. It is likely that more money was spend on financial planning for their marriage than the actual marriage itself, considering the two large legal factors that will play into their finances as a couple:

• The first legal issue is that California is a Community Property state, which means that any money earned in the course of the marriage belongs to the both Zuckerberg and Chan. However, any money or property that one of the spouses earned before the marriage and any inheritance received in the either in the course of or before the marriage is considered to be separate property. Each spouse owns a one-half share in all community property. For Zuckerberg and Chan, this means that Chan is not entitled to any money produced from his?Facebook stock because the couple married after the Zuckerberg received the initial public offering for his company. However, Chan is entitled to one-half the difference between the initial public offering and any money produced from an increase in the stock's value.
• There are also certain tax advantages to the marriage. Reportedly, Zuckerberg has already taken advantage of the gift tax, by making $ 37 million in gifts to his unborn children. Furthermore, Zuckerberg can take advantage of the fact that California does not have an estate tax, and he can also take advantage of the unlimited martial deduction, which provides him the opportunity to avoid taxes on property that he gives or receives from Chan.?

With a trust, such as a revocable living trust, a person planning an estate places all of their assets into the instrument while they are still alive. Additional assets can be added to the trust as they are acquired. The reverse is true for assets that have been sold or disposed of prior to death. At the time of a person's death, the trustee who has been appointed to administer the estate will distribute the trust according to its directives. This type of trust does not need to be probated in the court.

There are many types of trusts and wills to be considered in estate planning. Each estate has different needs. It does not matter the size of the estate to be planned, but it is important that a person in Tennessee make their wishes known to their heirs.
